Muhammad Ali of Egypt used contracts called concessions to build cheap infrastructure – dams and railways – with foreign European companies seeking capital, building projects and recovering most of the operating revenue, but Ali`s government would provide some of that revenue. Despite the fact that the two types of documents determine the transfer of rights from one person to another, these types of agreements have several fundamental differences: within the European Union, the award of concessions by public bodies is subject to regulation. Construction concessions have been subject to procurement rules for some time, as Directive 2004/18/EC of the European Parliament and of the European Council on public procurement applies to construction concessions, and cross-border service concessions are governed by the principles of the Treaty on the Functioning of the European Union. However, on 26 February 2014, the European Parliament and the European Council adopted a new Directive 2014/23/EU on the award of concession contracts, which obliged EU Member States to introduce national legislation for the award of concession contracts costing EUR 5 186 000, which were awarded on or after 18 April 2016. Each of the parties to a commercial concession contract concluded for a specified period or without specifying its period of validity has the right to terminate the agreement by notifying the other party no later than thirty days if the agreement provides for the possibility of terminating it by payment of the sum of money fixed in the quality of the compensation. In the early stages of PPP in India, several national governments and government authorities developed their own concession contracts. This has resulted in implementation difficulties.
In 2000, the Planning Commission was launched with the first Model Concession Contract (MCA) for the motorway sector. For other sectors, WABs were then developed for other sectors, on the model of the planning commission. The development of WABs has made it possible to standardize concession agreements and increase the consistency and efficiency of transactions.
